By creating an account, using our AI interfaces, APIs, or browsing the Site, you confirm you are at least 18 years old (or age of majority) and have legal capacity. If using on behalf of an entity, you warrant authority to bind that organization.

These Terms, together with our Privacy Policy and AI Ethics Addendum, govern your use of BlueHorde’s Services (text generation, image synthesis, data analysis, etc.). We may modify Terms at any time; changes are effective upon posting. Continued use means acceptance.

No Professional Advice: AI outputs are not a substitute for professional judgment. Do not rely on them for legal, medical, financial, or other critical decisions without human review.

Use at Your Own Risk: You acknowledge that AI systems may produce content that infringes rights or contains errors. BlueHorde disclaims all liability arising from your use of AI outputs.

2.1 Content Moderation

We may use automated filters to block harmful content, but cannot guarantee all inappropriate outputs are prevented. You agree not to generate illegal, defamatory, harassing, or policy-violating content.

You may need an account to access certain AI features. Provide accurate information and maintain confidentiality. You are responsible for all activity under your account. Notify us immediately of unauthorized use. BlueHorde may suspend/terminate accounts that violate these Terms or abuse AI resources.

API & Rate Limits: Use of AI endpoints is subject to rate limits. We may throttle or restrict usage to preserve service quality.

BlueHorde IP: The Site, software, models (excluding third-party base models), and branding are owned by BlueHorde or licensors. You may not copy, modify, or reverse engineer except as permitted by law.

Your Content & AI Outputs: You retain ownership of Input. As between you and BlueHorde, you own the Outputs generated from your Input, provided they do not infringe others' rights. However, similar outputs may appear for other users. BlueHorde gets a limited license to use Input/Outputs to provide, improve, and develop AI Services (including training and safety). This license is revocable by deleting your account (subject to retention).

Third-Party Models: Our AI may incorporate open-source or licensed models; additional terms may apply.

Prohibited activities include:

• Generating illegal content, CSAM, or material promoting violence/terrorism.
• Creating non-consensual deepfakes or impersonating individuals for deception.
• Automated scraping, excessive API calls, or probing model vulnerabilities.
• Using AI outputs to develop competing models without permission.
• Inputting others' personal data without lawful basis.
• Bypassing safety filters, generating spam, phishing, or malware.

BlueHorde may investigate violations and cooperate with law enforcement.

The Site may integrate or link to third-party platforms (model providers, payment processors). BlueHorde does not control them and is not liable for their content or practices. Interactions are solely between you and the third party.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUEHORDE DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI OUTPUTS WILL BE ACCURATE OR ERROR‑FREE.

LIMITATION OF LIABILITY: IN NO EVENT SHALL BLUEHORDE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS OR DATA, ARISING FROM USE OF SERVICES OR AI OUTPUTS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 USD OR AMOUNTS PAID IN THE PAST SIX MONTHS.

Some jurisdictions do not allow certain limitations; these apply to the fullest extent permitted.

You agree to indemnify and hold harmless BlueHorde and its affiliates from any claims, damages, or expenses (including legal fees) arising from your violation of these Terms, misuse of AI Services, or content you generate/distribute using BlueHorde.

We may suspend or terminate your access at any time for breach of these Terms. Upon termination, rights granted to you cease. Provisions regarding ownership, disclaimers, and liability survive.

These Terms are governed by the laws of Delaware, USA, without regard to conflict of law principles. Any dispute shall be resolved exclusively in the state or federal courts located in Wilmington, Delaware. You waive any objection to venue.

Informal Resolution: Before filing a claim, contact legal@bluehorde.com and attempt informal resolution for 30 days.

These Terms constitute the entire agreement. If any provision is unenforceable, the remainder stays in effect. Our failure to enforce any right is not a waiver.
